H2A Visa Eligibility Requirements
Employers and foreign workers must each meet certain requirements to qualify for the H2A visa:
Temporary or Seasonal Employment: The job must be seasonal (it must come around to the same time of year every year), or temporary (it must occur at only a certain time of year).
Labor Shortage: Employers must show that there are not a sufficient number of available, willing, qualified, and able U.S. workers to fill the position, despite recruitment efforts
Labor Certification: The employer must obtain a temporary labor certification from the US Department of Labor (DOL) which shows that hiring foreign workers will not adversely affect the wages and working conditions of US workers.

The H2A Visa Process
The process of hiring H2A (temporary foreign workers) is complicated and lengthy with several steps involved. Here is the gist of each step.
- The first step is to create a job order from the state workforce agency.
- Then, have the job order approved and posted to the ETA website for a minimum of 30 calendar days.
- Once the job order is approved, the employer must provide the WIA office with the name of the job recruitment option used (newspaper, radio, etc.)
- After the WIA office approves the job recruitment option, the employer can start recruiting H2A workers.
- When the recruiting finishes, the WIA must determine whether the employer has made a good-faith effort to recruit.
- Based on the results, the WIA will either approve or deny the employer’s request for H2A workers.
Labor Certification
Employers must apply for a temporary labor certificate from the Department of Labor proving that efforts have been made to hire US workers but that so far no US workers are available.
Certification Approved
The employer then completes Form I-129, Petition for Nonimmigrant Worker, with USCIS filing the petition and documenting the job and workers to be hired once the certification is approved.
H2A visa
Foreign workers apply for the H2A visa at a U.S. consulate in their home country, or they change the status if they’re already in the US.
