F4 Visa Assistance for Family Members of U.S. Citizens

If you are a US citizen, you may file a petition to sponsor your brother or sister and their spouse and any unmarried minor children (your nieces and nephews) for lawful permanent residence in the US. F4 visa is a family-sponsored immigrant classification, meaning that your family member qualifies for a green card because you as a US citizen who filed the petition for them are in a particular category. How Does the F4 Visa Process Work?

Filing the Petition

The sponsoring petitioner is required to submit Form I-130, which will detail the nature of the relationship between the family member and the petitioner. Evidence of family relationships will typically include birth certificates and other evidence of parental ties.

Approval and Wait Time

Once the petition is approved, the sponsored sibling is put on the F4 category of family-sponsored visas. Because there is a cap on the total number of F4 visas given in any given year, it is likely that applicants will need to wait several years before the visa is granted. The length of the wait depends on the home country of the applicant and the Visa Bulletin issued by the U.S. Department of State.

National Visa Center (NVC) Processing

Once your priority date becomes current, your case will be passed to the National Visa Center (NVC), which will request additional documents and fees before the case can be sent to the US embassy or consulate that will process the immigration petition. After the NVC has received both the documents and the fees, the sponsored sibling (and accompanying relatives) will be vetted through a background check and be scheduled to meet at a US embassy or consulate for collection of biometrics, a medical exam, and an interview.

Visa Approval and Green Card

If your sibling passed the interview and their visa request was granted, they would be issued immigrant visas to travel to the US and collect green cards.

Required Documents for the F4 Visa

To successfully complete the F4 visa process, the following documents are typically required:

  • Form I-130 (Petition for Alien Relative): Filed by the U.S. citizen sponsoring the sibling.
  • Evidence of United States citizenship: Copy of petitioner’s United States passport, certified copy of petitioner’s birth certificate, or certified copy of petitioner’s naturalization certificate.
  • Proof of Relationship: Copy of petitioner’s and the sibling’s birth certificates to show the relationship between them.
  • Marriage Certificate (if applicable): For the sponsored sibling, if their spouse is also applying.
  • Children’s Birth Certificates: For any unmarried children under 21 included in the application.
  • Affidavit of Support (Form I-864): Demonstrates that the sponsor has the financial ability to assist the immigrant family members.
  • Termination of Prior Marriages, if Any: Divorce decrees or death certificates for petitioner or sibling.
  • Passport Photographs: Recent passport-sized photos of the sponsored sibling and family members.
  • Medical Examination and Vaccination Records: Required for the visa interview.
  • Police Clearance Certificates: Showing that the sponsored sibling has no criminal record.

The F4 Visa Interview Requirement

In addition, all F4 visa applicants must attend a personal interview at a US embassy or consulate overseas when their priority date becomes current. At that interview, a consular officer will determine whether the sibling and his accompanying family members are eligible for the visa.

The interview is a crucial step. When your sibling’s priority date becomes available, they’ll be scheduled for an interview with a consular officer at the U S embassy or consulate closest to their home. The consular officer will ask questions to verify the information in the application, such as the nature of your relationship, where they’ve been and what they’ve done, and what they plan to do in the U.S.

This is also where they’ll look at your sibling’s files, including medical exams, police clearance certificates, and evidence of financial support. It’s vital that we prepare here and make sure that ‘all ducks are in a row’ so that there are no last-minute surprises.
