How To Apply for an IR5 Visa?

Here is a detailed breakdown of each step involved in the process of applying for an IR5 visa.

Step 1: Qualification Criteria for Eligibility

A sponsoring U.S. citizen must be at least 21 years old, able to make sufficient financial contributions to support the parent, have a US residence, and be able to prove their relationship with parents, usually by means of a birth certificate. The beneficiary’s status depends on whether they are in or outside the United States; if applying from abroad, the parent will need to present proof of connection and fill out the immigrant visa application, Form DS-260.

Step 2: Create the Parent-Child Relationship

If approved, the sponsor submits Form I-130 along with the appropriate paperwork to demonstrate their US citizenship, age, and parent-child status. The necessary papers usually include filing fee, passport-sized photographs, sponsor’s naturalization certificate/birth certificate, US passport and proof of name changes, if necessary. After the approval of I-130, if the beneficiary is outside the US, the application goes to the consulate for processing.

3. Fill out and submit forms DS-260 and DS-261

Once the I-130 is approved, the petition goes to the National Visa Center (NVC), which issues a confirmation number and then an immigrant visa number. The beneficiary will need to submit Form DS-261 to the Consular Electronic Application Center and pay the fee. Then, they provide Form DS-260, the green card application, which is dealt with by the NVC, which may require further documents to establish the relationship.

4. Fill the Medical Examinee Form

An official medical checkup by a licensed doctor follows. The physical exam covers diseases, immunization history, mental and physical health screening. Beneficiaries must bring proof of vaccination, medical record, and government photo ID. The physician will attach the records to a sealed envelope for mailing to USCIS.

Step 5: Provide Biometric Information (If Available)

The beneficiary also makes a biometrics appointment and gets their picture and fingerprints taken. This appointment, in a U.S. consulate or embassy for applicants from outside the United States, is critical for identity verification and background checks.

Step 6: Go for Green Card Interview

Finally, there is the green card interview which happens 7 to 15 months after filing the application. An interview with a USCIS officer involves verification of the application information and showing of the documents. Some applicants may want to bring an immigration lawyer for assistance.

Duration of IR5 Visa

Once the IR5 visa is issued to the parents, the green card issued is for a duration of 10 years. Green cards can be renewed before expiry, and the parent can apply for naturalization to become U.S. citizens.

How Long Does it Take to Get IR5 Visa?

Usually, it takes up to a year for you to get and obtain an IR5 visa. Like with all the U.S. visas, getting the IR5 takes several steps and involves paying fees to US Citizenship and Immigration Services (USCIS).

Depending on: The specific timeline of obtaining an IR5 visa may vary.

  • The speed at which forms are processed.
  • The efficiency of the US embassy or consulate in your parent’s country of origin.
  • Any factors outside the process that could impact the processing time.
