Children of the K-1 Visa recipient can travel with their parent to the United States or join later, as long as the K-1 recipient and U.S. citizen marry within 90 days of entering the U.S. Once the parent and U.S. citizen marry, children can apply for a green card and start their process to become a U.S. permanent resident.

The K-2 Visa Application Process

Here’s a breakdown of the steps involved in applying for a K-2 Visa:

To begin, the US citizen fiancé files Form I-129F

Petition for Alien Fiancé. It includes details about the child or children who will apply for the K-2 visa.

USCIS Approval

When USCIS approves the petition, the case is sent to NVC, and then to the US embassy or consulate in the child’s home country.

Visa Interview

The child is scheduled for a visa interview at the US consulate during which time he or she will present the their passport and documentation proving the child’s relationship to the K-1 Visa holder and the child’s own medical exam results. The consular officer will ask questions to confirm the child’s eligibility to enter the United States on a K-2 Visa.

Visa Issuance

Once the visa is approved, the child can travel with the parent or join them at a later date

Adjustment of Visa Status

After the U.S. citizen and K-1 Visa holder marry, the child can apply for adjustment of status to become a lawful permanent resident (green card holder).
